Terms of Use
These Terms of Use govern your use of https://mcspaddenhomes.com and any other site we operate that links to them (the "Site"). The Site is operated by McSpadden Homes ("McSpadden Homes," "we," "us," or "our").
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who may use the Site
The Site is intended for adults 18 and over located in the United States. By using it, you confirm you are at least 18 and legally able to enter into these Terms.
2. The Site is informational
Everything on the Site is provided for general information about McSpadden Homes and the design and construction services we offer.
Nothing on the Site is an offer, a contract, or a commitment to build. No plan page, rendering, price, specification, or communication through the Site creates any obligation on our part. A binding relationship between us begins only when both parties sign a written agreement, and that agreement — not this Site — controls the scope, specifications, schedule, and price of any project.
3. Plans, renderings, and specifications
This section matters, so please read it carefully.
Plans are starting points. The designs in our plan library are semi-custom plans intended to be modified. Any plan may be revised, renamed, withdrawn, or discontinued at any time without notice.
Dimensions and square footages are approximate. Bedroom counts, bathroom counts, garage capacity, story counts, and square footage figures shown on the Site are approximate and are calculated using our own measurement conventions, which may differ from those used by appraisers, tax assessors, real estate listings, or other builders. Actual as-built dimensions will vary. Do not rely on figures from the Site for financing, appraisal, insurance, resale, or lot-fit decisions.
Images show optional features. Photographs, renderings, elevations, and floor plan graphics frequently depict optional upgrades, custom selections, landscaping, pools, furnishings, and finishes that are not included in a plan's base configuration. Elevations, materials, and colors shown may not be available in every community or on every lot.
Site and code conditions govern. Whether any plan can be built on a particular lot depends on lot dimensions, topography, soil conditions, setbacks, easements, utility access, applicable building codes, and any homeowners association or architectural review requirements. We make no representation that any plan can be built on any particular property.
No pricing. The Site does not publish construction pricing. Any figures discussed in conversation, correspondence, or preliminary materials are estimates only until set out in a signed agreement.
4. Intellectual property
The Site and its contents — including the plan designs, floor plans, elevations, renderings, brochures, photographs, video, text, layout, and the McSpadden Homes name and logo — are owned by McSpadden Homes or our licensors and are protected by United States copyright, trademark, and other intellectual property laws.
Architectural works. Our home designs and the drawings depicting them are protected as architectural works and technical drawings. You may not construct, or permit anyone to construct, a dwelling based on any plan, floor plan, elevation, or brochure published on the Site, whether copied directly or adapted, without a written license from us.
What you may do. You may view the Site and download or print materials we make available for download, for your own personal, non-commercial use in evaluating whether to work with us.
What you may not do. You may not copy, reproduce, republish, distribute, sell, license, modify, or create derivative works from Site content; use it for any commercial purpose; use automated tools to scrape, crawl, or harvest content or contact information; remove copyright or trademark notices; or use our name, logo, or photographs in a way that suggests affiliation or endorsement.
5. Submissions and feedback
If you send us project information, plans you own or have licensed, photographs, ideas, or feedback, you confirm that you have the right to send them and that doing so does not violate anyone else's rights. You grant us a non-exclusive, royalty-free license to use what you send for the purpose of responding to you and evaluating your project.
If you provide us with plans prepared by another architect or designer, you are responsible for holding the rights or license necessary for us to review, modify, and build from them, and you agree to indemnify us against any claim that our use of those plans infringed someone else's rights.
Do not send us confidential information you do not want us to use. We treat unsolicited general ideas and feedback as non-confidential.
6. Accounts and the vendor project library
Some areas of the Site require an account, including the vendor project library available to authorized trade contractors and vendors.
If you have credentials, you are responsible for keeping them confidential and for all activity under your account. Notify us immediately if you believe your credentials have been compromised.
Documents in the vendor project library are confidential and are provided only for the exclusive use of the authorized trade contractor or vendor in performing work on the specific project. You may not disclose, copy, forward, or reuse them for any other purpose or project. We may suspend or revoke access at any time.
7. Third-party sites and services
The Site links to and embeds content from services we do not control, including mapping, video, and community websites. We provide these links for convenience. We are not responsible for the content, accuracy, or practices of any third-party site or service, and a link does not imply endorsement.
8. Equal Housing Opportunity
McSpadden Homes supports and complies with the Fair Housing Act and all applicable federal, state, and local fair housing laws. We do business without regard to race, color, religion, sex, handicap, familial status, or national origin.
9. Acceptable use
You agree not to use the Site to:
- Violate any law or regulation
- Infringe anyone's intellectual property or privacy rights
- Transmit malware, spam, or other harmful code or content
- Attempt to gain unauthorized access to the Site, any account, or any connected system
- Interfere with the operation of the Site or place unreasonable load on it
- Impersonate any person or misrepresent your affiliation
- Collect information about other users
10. Disclaimer of warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the content is accurate, complete, or current. We may change or remove any content at any time without notice.
This section applies to the Site only. It does not limit or affect any warranty contained in a signed construction agreement between us.
11. Limitation of liability
To the fullest extent permitted by law, McSpadden Homes and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the Site — even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to the Site will not exceed one hundred dollars ($100).
Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of sections 10 and 11 may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless McSpadden Homes and its owners, officers, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
13. Governing law and disputes
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of laws rules. Any dispute arising out of or related to the Site or these Terms will be brought exclusively in the state or federal courts located in York County, South Carolina, and you consent to the jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms at any time. Changes take effect when posted, and we will update the effective date above. Your continued use of the Site after we post changes means you accept them.
15. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. You may not assign these Terms; we may.
